SC: For Conviction u/s 149 IPC, Accused Must be Aware of Offence to be Committed - (13 Oct 2023)

CRIMINAL

Supreme Court has held that to convict a person under Section 149 IPC prosecution must establish that firstly, accused shared a common object and was part of unlawful assembly and secondly, that he was aware of offences likely to be committed is to achieve the said common object.
