Hearing complaints of how the upper echelon of the Indian National Congress political party illegally acquired several thousand crores worth of Associated Journals Private Limited assets, the Delhi High Court raised concerns over “Office Bearers of the Congress Party are siphoning off the party funds…when the source of Congress Party’s fund is largely from donations given by public”. The Court struggled to stay within its remit, repeating severally how it could not be said that “the ingredients of the offences alleged are lacking”, and restraining itself, only just from prospecting into the merits of the case and professing a quick judgment.

Ultimately, the Court was only ever going to be able to rule on the validity of summons issued by a trial court in the city, and so it did. Mala fides against the complainant were rejected and the “serious imputations smacking of criminality” sufficed to uphold summons of the senior Congress members to the trial court.
