Del. HC: Mere Global Reputation Not Sufficient to Answer Claim of Transborder Reputation - (01 Dec 2023)

INTELLECTUAL PROPERTY RIGHTS

Delhi High Court while observing that mere global reputation/asserted goodwill of Trade Mark is not sufficient to answer a claim of transborder reputation, has held that unless a sizeable imprint of presence of mark is established amongst consuming public, claimant is not entitled to protection.
