Global Conference on Strengthening Arbitration and Enforcement in India - (21 Oct 2016)

The National Institution for Transforming India (NITI Aayog) organised a three day Global Conference for strengthening National Initiative towards Strengthening Arbitration and Enforcement in India from 21st October 2016 – 23rd October 2016 in New Delhi. The Conference was inaugurated by President of India Shri Pranab Mukherjee on 21 October 2016.

The Chief Guest of the closing day was the Prime Minister of India Shri Narendra Modi. The Hon’ble the Chief Justice of India Justcie T. S. Thakur was the Chief Patron of the Conference. The Conference was attended by number of Judges of the Supreme Court of India and also by the Chief Justices of the neighbouring countries such as Bhutan, Singapore, Bangladesh etc.

The NITI Aayog has taken a pro-active step in strengthening the cause for providing better atmosphere for Arbitration and its implementation in India. The NITI Aayog is a premier policy ‘Think Tank’ of the Government of India, providing both directional and policy inputs and draws strategic and long term policies and programmes for the Government of India and also provides relevant technical advice to the Centre and States.

The NITI Aayog has been recently formed by the Government of India on 1st January, 2015 by replacing the age old Planning Commission. NITI Aayog is playing an important role in initiating such positive steps towards giving Arbitration its due respect and place and in fact has shown the indication that the government is also serious as well as eager to promote and create a better platform for Arbitration India in a positive manner.

This Conference is historic in a way as the Government of India has approached globally and for the first time, leading International Arbitral Institutions such as ICC International Court of Arbitration, SIAC- Singapore International Arbitration Centre, LCIA- London Court of International Arbitration, PCA-Permanent Court of Arbitration, HKIAC- Hong Kong International Arbitration Centre, KLRCA- Kuala Lumpur Regional Centre for Arbitration and all major industry associations such ASSOCHAM,CII FICCI etc. had participated in it.

The Conference witnessed the participation of Lawyers, Sitting Judges, Former Judges, Arbitrators, Law makers and Industry experts who discussed on various aspects on Arbitration and its implementation in India. The 3 day Conference was divided into various sessions inviting participation on discussing and brainstorming various issues including critical analysis of Arbitration and Conciliation Act 1996 and its Amendments in 2015, Steps towards setting up of world class Arbitral Institute, the role of the Courts in India differs at different stages i.e. Before, During and Post Rendering of the Arbitral Award, and also on strengthening Arbitration Internationally and focusing on India’s role to provide a blueprint for the steps that are critical in strengthening arbitration and its enforcement in India and across the globe.

Overall, the Conference saw positive and equal participation from all quarters including the Government, Courts, Lawyers, Industry experts, Arbitrators and International Arbitral Institutions which in future shall infuse positive hope and pave way for strengthening Arbitration in India and putting India as Arbitration hub on world map.
