Supreme Court: Section 161 CrPC Statements Can Be Considered at Cognizance Stage, Not at Trial - (13 Oct 2026)

CRIMINAL

Supreme Court held that statements recorded under Section 161 CrPC/Section 180 BNSS cannot be relied upon at trial but may be considered at the cognizance stage. It set aside the Patna High Court’s interference with the Magistrate’s cognizance order based on such statements.
