SC: CIRP Can Continue Despite Fraudulent Insolvency Plea That Triggered It - (05 Oct 2026)

INSOLVENCY

Supreme Court held that a CIRP under the IBC may continue even if the insolvency plea initiating it was fraudulent or collusive. It ruled that while the NCLT can recall an admission obtained by fraud, such fraud does not automatically terminate the entire CIRP.
