SC: CIRP Need Not Be Set Aside Solely for Fraudulent Filing of Section 9 Plea - (01 Oct 2026)

INSOLVENCY

Supreme Court held that a Section 9 insolvency admission may be recalled if based on fraudulent or collusive jurisdictional facts. However, fraud alone does not end the CIRP; the Adjudicating Authority must separately assess whether its continuation serves stakeholders’ interests.
