Supreme Court: Compromise Decree Passed Without Impleading Necessary Party is Void - (01 Oct 2026)

PROPERTY

Supreme Court held that a compromise decree in a partition suit over coparcenary property is a nullity if a necessary party was not impleaded. The omitted party may seek recall of the decree before the same court that passed it.
