Delhi HC: Magistrate Must Examine Complainant, Hear Accused Before Taking Cognisance - (30 Sep 2026)

Delhi High Court held that under Section 223(1) BNSS, a Magistrate can take cognisance of a private complaint only after examining the complainant and witnesses on oath and giving the accused an opportunity to be heard, both being mandatory pre-cognisance steps.
