Delhi HC: Re-Arrest Without Magistrate's Permission Invalid if Earlier Arrest was Vitiated - (29 Sep 2026)

CRIMINAL

Delhi High Court held that an accused released due to failure to furnish grounds of arrest under Article 22(1) cannot be re-arrested at the investigating agency’s discretion. The Supreme Court-mandated procedure, including prior judicial approval, must be followed.
