SC: Article 311 Bar Inapplicable If Removing Officer Equals Appointing Authority in Status - (25 Sep 2026)

SERVICE

Supreme Court held that Article 311(1) applies only when the removing authority is subordinate in rank to the appointing authority. Mere delegation of disciplinary powers to a subordinate officer under statutory rules does not attract the constitutional bar.
