SC: Contractual Bar Prevents Arbitral Tribunal From Awarding Pre-Reference Interest - (25 Sep 2026)

ARBITRATION

Supreme Court held that arbitral tribunals cannot award pre-reference interest on delayed payments where a contractual clause expressly bars it under Section 31(7)(a) of the Arbitration and Conciliation Act, 1996. It set aside the Meghalaya High Court’s judgment restoring such an award.
