Calcutta HC Upholds ITC Injunction, Says ‘Gold’ Has Acquired Secondary Meaning - (21 Sep 2026)

Calcutta High Court held that passing off and trademark infringement actions can lie against a registered permitted user where registration is disputed. In ITC’s ‘Gold Flake’ dispute, it found a prima facie case that ‘Gold’ had acquired secondary meaning through long commercial use.
