Gujarat HC: Illegal Mining Vehicle Complaints Must Be Filed Before Sessions Court, Not Magistrate - (03 Sep 2026)

MINES AND MINERALS

Gujarat High Court held that complaints involving vehicles seized for illegal mining must be filed before the Sessions Court under Rule 12(2)(b)(ii). If no complaint is filed within 45 days, the vehicle must be released without insisting on a bank guarantee.
