SC: S.69 Evidence Act Applies to Will Only if S.68 Attestation Proof is Impossible - (18 Aug 2026)

LAW OF EVIDENCE

Supreme Court held that Section 69 of the Indian Evidence Act, 1872, cannot replace the ordinary mode of proving a Will under Section 68. Section 69 may be invoked only after the propounder establishes that no attesting witness can be found to prove the Will under Section 68.
