J&K&L HC: Complaint Dismissed Before Cognisance is Not an Acquittal & is Challengeable U/S 528 BNSS - (24 Jul 2026)

CRIMINAL

J&K and Ladakh High Court held that only dismissal of a criminal complaint after issuance of process amounts to an acquittal under Section 279 BNSS. A pre-cognizance dismissal is not an acquittal and may be challenged through revision or under Section 528 BNSS.
