Supreme Court: Refund Clause in Sale Agreement Does Not Extinguish Right to Specific Performance - (17 Jul 2026)

CONTRACT

Supreme Court held that a refund clause for earnest money in an agreement to sell does not by itself bar the purchaser from seeking specific performance, as such a provision does not absolve the seller of the obligation to fulfil the contract.
