Kerala HC: Re-Arrest is Allowed After an Illegal Arrest With Prior Judicial Approval - (07 Jul 2026)

CRIMINAL

Kerala High Court has held that an accused released due to violations of Articles 22(1) or 22(2) of the Constitution may be re-arrested for the same offence, provided the arrest is preceded by judicial scrutiny and is not carried out automatically.
