Delhi HC: Pre-Summoning Evidence Opportunity Must be Granted Even in Civil-Natured Criminal Cases - (25 May 2026)

CRIMINAL

Delhi High Court held that even if a Magistrate refuses FIR registration under Section 156(3) CrPC, the complainant must ordinarily be allowed to lead pre-summoning evidence before dismissing the complaint as civil, as the line between civil breach and criminal offence is often thin.
