Gujarat High Court: Separate Compensation is Payable For Stillborn Child in Railway Accident Case - (08 May 2026)

Gujarat High Court held that a 9-month foetus is to be treated as a child, allowing compensation under the Railways Act for a stillborn child. It ruled that the death of the unborn child amounts to a separate accident from the mother’s death, granting compensation to the father for both losses.
