Bombay HC: Courts Cannot Mandate Mediation under Mediation Act 2023 Without Mutual Consent - (06 May 2026)

Bombay High Court held that the Mediation Act, 2023 does not empower courts to compel parties to undergo mediation without mutual consent, clarifying that mediation under the statutory framework is inherently voluntary and cannot be imposed unilaterally on litigating parties.
