J&K&L HC: Delay in Executing Preventive Detention on Unsubstantiated Medical Ground Makes it Invalid - (28 Apr 2026)

CRIMINAL

Jammu & Kashmir and Ladakh High Court held that a preventive detention order cannot stand if medical grounds for non-execution are unsubstantiated and there is unexplained delay in execution, as such lapses raise serious doubts about the detaining authority’s subjective satisfaction.
