J&K&L HC: Preventive Detention Invalid When Based on Speculative Fear of Election Disturbance - (23 Apr 2026)

CONSTITUTION

High Court of Jammu & Kashmir and Ladakh held that a preventive detention order based on speculative apprehension of disruption to Parliamentary elections, without any proximate or concrete material, lacks a live nexus and is therefore liable to be quashed.
