SC: Participation In Arbitration Does Not Bar Challenging Arbitrator’s Inherent Jurisdiction - (26 Mar 2026)
ARBITRATION
Supreme Court has held that where no valid arbitration agreement exists, a party’s mere participation in unilaterally initiated arbitration proceedings does not create estoppel, and it may still challenge the arbitral award as being legally non-existent.
