J&K&L HC: Sec 195 CrPC Bars Cognizance Without Public Servant's Complaint, Not FIR or Investigation - (24 Mar 2026)

CRIMINAL

J&K & Ladakh High Court held that Section 195 CrPC bars courts from taking cognizance of offences under Sections 172–188 IPC without a complaint by the public servant. It does not prevent FIR registration or investigation, and such objections arise only at charge or discharge stage.
