Calcutta High Court: Transfer to Commercial Court No Bar to Counterclaim with Leave - (20 Feb 2026)

CIVIL

Calcutta HC held that under the Code of Civil Procedure, a defendant may file an additional written statement or counterclaim with the court’s leave, even after submitting an earlier statement, and upheld the Commercial Court’s acceptance of a fresh statement with counterclaim post-transfer.
