Delhi High Court: Elective Surgery Does Not Bar Grant of Interim Bail on Medical Grounds - (04 Feb 2026)

CRIMINAL

Delhi High Court held that the non-emergency nature of a medical procedure alone cannot justify denial of interim bail, especially where ongoing pain requires timely surgery, while allowing an accused under MCOCA to seek bail to attend his mother’s scheduled knee replacement.
