MP HC: Trial Courts Cannot Grant Permanent Injunction in Title Suits Without Recovery of Possession - (15 Jan 2026)

MP HC set aside a trial court order in a title suit, holding that the court erred in granting a decree of permanent injunction without awarding the consequential relief of recovery of possession, despite finding that the defendant had encroached upon the plaintiff’s land.
