NCLAT: Misnaming Guarantor as 'Director' in SARFAESI Notice Doesn't Void Guarantee Invocation - (09 Jan 2026)

INSOLVENCY

NCLAT, New Delhi, has ruled that merely referring to a personal guarantor as a “Director” in a SARFAESI notice does not invalidate the guarantee’s invocation, provided the notice clearly demands payment of the outstanding dues under the personal guarantee deed.
