NCLT Kochi: Avoidance Provisions under Insolvency Code Aim to Restore, Not Punish, Parties - (08 Jan 2026)

INSOLVENCY

NCLT Kochi clarified that avoidance provisions under the Insolvency Code are intended to reverse the preferential effect of certain transactions and restore the corporate debtor’s estate, rather than impose punitive liability on the beneficiaries of such transactions.
