SC: Mere Participation in Arbitration Doesn’t Bar Challenging Arbitrator; Waiver Must be in Writing - (06 Jan 2026)
ARBITRATION
Supreme Court ruled that participation in arbitration does not waive the right to challenge an arbitrator’s eligibility, clarifying that any waiver must be expressly made in writing and rejecting the idea of a deemed waiver under Section 12(5) of the Arbitration & Conciliation Act, 1996.
