J&K&L HC: Women Accused in Non-Bailable Offences Form a Distinct Class Beyond Sec 437 CrPC Rigour - (02 Jan 2026)

CRIMINAL

Reiterating that women accused of non-bailable offences form a distinct class warranting special consideration, the J&K&L HC granted bail to three women undertrials in a murder case, holding that courts should not be constrained by the rigour of Section 437 CrPC while deciding their bail pleas.
