Calcutta HC: Award May Be Set Aside if Tribunal Rewrites Contract or Ignores Key Clauses - (26 Dec 2025)

ARBITRATION

Calcutta High Court held that an arbitral tribunal cannot rewrite contractual terms or ignore determinative clauses on grounds of equity or fairness, and that travelling beyond the contract amounts to a jurisdictional error rendering the award illegal.
