NCLT Hyderabad: Mortgaging Property Without Lending Money Does Not Constitute Financial Debt - (22 Dec 2025)

INSOLVENCY

NCLT Hyderabad held that a person who merely mortgages property as collateral without advancing any funds cannot be considered a financial creditor of the borrower, as no actual lending or financial debt arises from providing security alone.
