Calcutta High Court: Mere Presence of Alcohol in Post-Mortem Cannot Bar Compensation to Heirs - (15 Dec 2025)

MOTOR VEHICLES

Calcutta High Court held that the mere presence of alcohol in a deceased accident victim’s post-mortem report cannot deny compensation to heirs under the Motor Vehicles Act, dismissing New India Assurance’s appeal and upholding the award to the motorcyclist’s family.
