NCLT Ahmedabad: Objections to Coc Cannot Bar RP From Challenging Preferential Transactions - (12 Dec 2025)

INSOLVENCY

NCLT Ahmedabad held that objections to the formation of the Committee of Creditors cannot prevent a Resolution Professional from filing an application under Section 43 of the IBC to challenge and reverse preferential transactions.
