INSOLVENCY

NCLAT at New Delhi held that a successful bidder in a liquidation e-auction cannot evade payment obligations by citing market fluctuations or unrelated delays, emphasizing acceptance of statutory terms, and set aside the NCLT Kolkata order directing refund of the Rs 2 crore earnest money deposit.
