Supreme Court: Property Transferred Before Filing a Suit Cannot be Attached under Order 38 Rule 5 - (01 Dec 2025)

Supreme Court clarified that when a property is transferred through a registered sale deed before the institution of a suit, it cannot be subjected to attachment before judgment under Order XXXVIII Rule 5 of the CPC, as such transfers fall outside the provision’s scope.
