NCLAT: NCLT Cannot Change Capital Structure of a Legally Compliant Successful Auction Purchaser - (24 Nov 2025)

INSOLVENCY

NCLAT held that the NCLT cannot alter the capital structure proposed by a successful auction purchaser when it is legally compliant, unopposed by stakeholders or the liquidator, and does not violate any law, reaffirming the purchaser’s rights under the insolvency process.
