Supreme Court: Indian Courts Cannot Appoint Arbitrators for Arbitrations Seated Outside India - (24 Nov 2025)

ARBITRATION

Supreme Court held that Indian courts cannot appoint arbitrators for international commercial arbitrations governed by foreign law and seated abroad, ruling that jurisdiction is lost regardless of any party’s Indian nationality once the contract provides for foreign-seated arbitration.
