Calcutta High Court: Juvenile Accused Eligible to Apply for Anticipatory Bail under Section 438 CrPC - (17 Nov 2025)

CRIMINAL

Calcutta High Court held that juveniles can file anticipatory bail applications under Section 438 CrPC. The court clarified that the Juvenile Justice Act, 2015, does not bar pre-arrest bail, and denying it would infringe a child’s fundamental right to personal liberty.
