NCLAT New Delhi: Public Auction Not Required for Sale of Encumbered Assets if Charge Holders Consent - (11 Nov 2025)

INSOLVENCY

NCLAT New Delhi set aside the NCLT order directing independent bidding for Arshiya Limited’s non-core assets during CIRP. The tribunal held that public auction is not mandatory for encumbered asset sales if secured creditors consent, under Regulation 29 of the CIRP Regulations.
