Kerala HC: Partial Specific Performance Not Allowed if Defendant Holds Undisputed Property Title - (10 Nov 2025)

Kerala High Court ruled that under Section 12(2) of the Specific Relief Act, 1963, a decree for partial specific performance cannot be granted if the defendant holds undisputed ownership of the entire property.
