Bombay HC: Appeal under Section 37 A&C Doesn’t Bar Fresh Arbitration Proceedings - (16 Oct 2025)

ARBITRATION

Bombay High Court held that the pendency of an appeal under Section 37 of the Arbitration Act does not prevent a party from initiating fresh arbitration if the earlier award has been set aside. It accordingly allowed a Section 11 application and appointed a sole arbitrator.
