NCLAT: ED Cannot Keep Attached Assets After Resolution Plan Approval - (16 Oct 2025)

INSOLVENCY

NCLAT held that asset attachments by the Enforcement Directorate under Prevention of Money Laundering Act (PMLA) cease once a resolution plan is approved under the Insolvency and Bankruptcy Code (IBC) meaning ED cannot retain attached assets after such approval ensuring smooth insolvency resolution.
