Bombay HC: Mortgage, Enforcement and Related Reliefs Not Subject to Arbitration - (15 Oct 2025)

ARBITRATION

Bombay High Court has held that mortgage enforcement is a right in rem and thus non-arbitrable. Disputes involving such enforcement must be pursued through a civil suit, as they cannot be referred to arbitration.
