SC: Public Possession Key for Valid Oral Gift under Mohammedan Law; No Mutation Raises Doubt - (07 Oct 2025)

Supreme Court held that an oral gift (hiba) under Muslim law cannot be used as a "surprise instrument" to claim property. For a valid hiba, the donor’s declaration, donee’s acceptance, and public possession of the land must all occur openly, ensuring transparency and legitimacy of the gift.
