Kerala HC: No Bar on Granting Pre-Arrest Bail if Substantive Offence under SC/ST Act is Absent - (22 Sep 2025)

CRIMINAL

Kerala High Court held that the bar on anticipatory bail under the SC/ST Act does not apply if there is a prima facie finding that the substantive offence under Section 3(2)(v), punishable with 10 years’ imprisonment, has not been committed.
