Bombay HC: Magistrate Need Not Pass Preliminary Order U/S 145 CrOC If HC or SC Directs Inquiry - (18 Sep 2025)

Bombay High Court held that when an inquiry under Section 145 of CrPC is directed by the High Court or Supreme Court, the Magistrate need not pass a preliminary order under Section 145(1). The higher court’s satisfaction about a dispute’s potential to cause a breach of peace suffices for the inquiry
