NCLAT: Sec 9 IBC Plea Can't Be Rejected For Wrong Notice Form If Invoices in It Are Unchallenged - (16 Sep 2025)

INSOLVENCY

NCLAT held that an application under Section 9 of the IBC cannot be rejected on a hyper-technical ground that the demand notice was issued in Form 3 instead of Form 4, especially when the notice included all invoices which the Corporate Debtor did not challenge as fake or fabricated.
